Your article discussing the Ruataniwha Dam (Pipe Dreams 6/8/15) claimed that Hawkes’ Bay Regional Investment Company had sought a legal opinion from Simpson Grierson. HBRIC did not seek this opinion, I should point out that in fact Hawkes’ Bay Regional Council did.
HBRIC vehemently disagrees with the advice given to HBRC and feels that it’s water users will still be allowed to pollute the Tukituki unabated, rather than having to meet the 0.8DIN set by the Board of Inquiry.
It would appear from comments made by staff at the last council meeting that HBRC disagrees with HBRIC’s position. Given that HBRC is the owner of HBRIC it will be interesting to see how the conflict of HBRC being both promoter and regulator plays out.
